CakeMarket Terms of Service (Hungary)

This document describes the planned CakeMarket model for Hungary and requires review by a qualified Hungarian attorney before production publication. It does not constitute legal advice.

Country and language

Legal documentation is maintained separately per country; this document applies to the Hungarian market (hu.cakemarket.app). The Hungarian version is the source and governing text, and this English page is its 1:1 courtesy translation. The structure mirrors the Polish source documents 1:1, differing only in country-specific points. The corresponding document for the Polish market is in the Poland section.

Operator details

CakeMarket is not a registered company yet. The operator's final company name, registered address, tax number (adószám) / company registration number and contact details must be completed before production publication.

§ 1. Service Model

1.1. CakeMarket connects Buyers looking for made-to-order cakes with Sellers operating within active Organisations in Hungary.

1.2. CakeMarket provides an online platform and intermediation service. As a rule, it is neither the producer of the cake nor a party to the contract for the sale/making of the cake between the Buyer and the Seller, unless a specific process explicitly states otherwise.

1.3. The Service is subject to Hungarian law and applicable EU law, in particular the GDPR, the DSA, the P2B Regulation, PSD2, and consumer-protection and food-safety legislation.

1.4. Using the Service requires being at least 18 years old and accepting these Terms.

§ 2. Definitions

§ 3. Account, guests and communication

3.1. Buyers may use part of the functionality as guests. A guest can track an order using a tracking link/token and later attach it to an account.

3.2. An account requires a valid e-mail address and the data needed to handle orders. The user is responsible for keeping their data up to date and for the security of their access.

3.3. Communication about offers and orders takes place through the messaging module and e-mail or in-app notifications. Messages may be linked to an Offer and an Order to provide a fulfilment history. Product and fulfilment issues are handled directly between the Buyer and the Seller.

§ 4. Requests, matching and offers

4.1. The Buyer creates a Request in the wizard, providing the data needed to prepare an offer, including flavour preferences, special requirements, theme description, date, fulfilment method and — for delivery — the address.

4.2. The Service matches the Request to active Organisations based on the Organisation's configuration, supported cake types, flavours, special requirements, lead time and pickup or delivery options.

4.3. The Buyer chooses an Offer on their own. The Service may sort offers by transparent parameters such as price, rating and certification level.

4.4. AI visualisations, portfolio photos and reference images are illustrative material. They do not guarantee that the finished cake will look identical, unless the Seller explicitly confirms a specific element in the Offer.

§ 5. Orders and payments

5.1. An Order is created when the Buyer accepts an Offer and successfully pays the Deposit online via Stripe.

5.2. The Deposit amount follows from the Offer and the Organisation's configuration; within the Service it ranges from 20% to 100% of the total price.

5.3. The Balance may be paid online via Stripe or offline in cash or by card at pickup/delivery, where the given option is available.

5.4. Funds from online payments remain in the platform account until the Order is completed. The Buyer may confirm receipt after delivery; if they do not, the funds are automatically released 3 days after the Order is marked as delivered. CakeMarket does not operate an adjudication or dispute-resolution process between the Buyer and the Seller.

5.5. The CakeMarket Commission is 10% of the total Order price. The current implementation records the commission when the Deposit is paid; no additional commission is charged on the Balance. The platform charges no commission on cancelled Orders: when the Seller cancels, every captured online payment (the Deposit and any online Balance) is returned to the Buyer, and when the Buyer cancels, the amount retained under the cancellation policy is passed on to the Seller in full.

5.6. Online payments are handled by Stripe. CakeMarket does not store full payment-card data.

§ 6. Fulfilment, pickup and delivery

6.1. The Seller manages the Order statuses: deposit paid, in progress, ready and delivered. An Order becomes completed after the Buyer confirms receipt or after the 3-day automatic-completion period, and it may also be cancelled under § 7.

6.2. For personal pickup, the Buyer chooses one of the Organisation's available pickup locations. For delivery, the Buyer provides an address and matching takes the Organisation's delivery range into account.

6.3. Once the Order is marked as delivered, the Buyer can confirm receipt and, after completion, leave a review. If there is a problem with delivery or the product, the Buyer should contact the Seller directly through the Order messages and exercise any rights against the Seller.

§ 7. Cancellations and refunds

7.1. The refund rules above are implemented in the payment integration: for a Buyer cancellation in the "deposit paid" status the system refunds 100% of the Deposit, in the "in progress" status 50% of the Deposit, and in the "ready" status or later 0%; when the Seller cancels, it refunds every captured online payment (the Deposit and any online Balance). Online refunds are initiated via Stripe and retried if a technical error interrupts settlement. The amount retained when the Buyer cancels is paid out to the Seller in full — the Platform retains no Commission from it.

7.2. Repeated cancellations, abuse or refusal to cooperate during fulfilment may result in account restrictions.

§ 8. Right of withdrawal and complaints

8.1. As a rule, a Consumer has a 14-day right of withdrawal from a distance contract under Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses, unless a statutory exception applies.

8.2. For cakes and confectionery, the exception for perishable goods or goods that retain their quality only for a short time may be relevant [Section 29 (1) point d) of Government Decree 45/2014. (II. 26.)], and for personalised cakes also the exception for non-prefabricated goods made on the Consumer's instructions or at their express request, or clearly personalised for the Consumer [Section 29 (1) point c)].

8.3. The Buyer may file a complaint if the product does not conform to the agreed specification. The Seller, as the party to the contract with the Buyer, is liable for the product's conformity.

8.4. CakeMarket provides communication tools but does not decide product, quality or fulfilment disputes. The Buyer submits complaints and pursues related claims directly against the Seller, without prejudice to mandatory Consumer rights.

§ 9. Food safety and allergens

9.1. The Seller, as a food-business operator, is responsible for food safety, hygiene, allergen information and legal compliance, in particular with Regulations (EC) No 178/2002 and 852/2004, Regulation (EU) No 1169/2011 and Act XLVI of 2008 on the food chain and its official supervision.

9.2. CakeMarket does not physically inspect premises, does not certify products and does not guarantee the absence of allergens. Information about special requirements serves to communicate the Buyer's expectations to the Seller.

9.3. Uploading a food-chain authority document is optional. The document is kept private and is available only to authorised CakeMarket administrators and active administrators of the Organisation. Customers see only a badge if CakeMarket issues one after reviewing the submitted document. The badge confirms only that the submitted document was reviewed for display; it is not authority verification, an inspection, an endorsement or a guarantee of legal compliance or product quality.

9.4. The Seller must provide the Buyer with the food and allergen information required by law before purchase and is solely responsible for its completeness and accuracy. Before purchase, the Seller must also ask the Buyer to disclose any relevant food allergy or intolerance and consider the response when agreeing and fulfilling the Order. The Buyer remains responsible for disclosing known allergies and intolerances; this does not create an allergen-free guarantee unless the Seller expressly agrees to one in writing. CakeMarket does not prepare, verify or guarantee the information.

§ 10. Reviews, ranking and moderation

10.1. After an Order is completed, the Buyer may leave a rating and a review.

10.2. Offer sorting may take into account the Organisation's rating, price and certification level. Sellers cannot buy a higher ranking position.

10.3. CakeMarket may remove content that is unlawful, infringes the rights of others, is misleading or violates the Service's terms, in line with DSA requirements where they apply.

§ 11. Liability and changes

11.1. CakeMarket is responsible for the proper provision of its own platform services. The Seller is responsible for the Offer, making and delivering the cake, food and allergen information, food safety, issuing any invoice or receipt required for the Buyer, tax information, complaints and settlements with the Buyer. CakeMarket issues only its own platform-fee invoice to the Seller after the Order is completed.

11.2. Limitations of liability do not exclude liability that cannot be excluded under mandatory provisions of law, in particular towards Consumers.

11.3. Material changes to these Terms will be communicated at least 14 days in advance, unless the law or the security of the Service requires a shorter period.

§ 12. Governing law and contact

12.1. These Terms are governed by Hungarian law. A Consumer may rely on the protection granted by the provisions applicable at their place of residence, where such provisions apply.
